We only collect the information strictly necessary to improve our services, while safeguarding your privacy. Please note that your username (pseudonym) and your associated scores will appear on public leaderboards, and you can request to be removed at any time.

1. Acceptance and Amendments
1.1. Use of AimX implies unconditional acceptance of these Terms of Use (hereinafter “ToU”).
1.2. The Publisher reserves the right to modify the ToU at any time, to comply with applicable laws or to adapt the Software to new features. Amendments take effect as soon as they are published.

2. Access and Use
2.1. Access and Age Restrictions: Access to AimX is exclusively through distribution platforms (Epic Games, Steam, etc.), which may enforce their own age restrictions and requirements. Compliance with these requirements is solely the responsibility of the User, and the Publisher has no control over such platform-specific policies.
2.2. Business Model: AimX is free to use, with in-app purchases managed by third-party platforms. Payment methods and refund policies depend on those services.
2.3. Technical Requirements: Users must have a suitable computer setup. The Publisher cannot be held responsible for technical problems caused by the User’s configuration.

3. Data Collection
3.1. Nature of the Data: AimX collects certain user data, including your username (pseudonym) for the purposes of creating a public leaderboard, as well as non-personal data (playing time, completed exercises, etc.).
3.2. Purpose of the Data:
* To improve the Software (performance analysis, tracking statistics, etc.).
* To display a public leaderboard with usernames (pseudonyms) and scores, allowing players to compare their performance.
3.3. Data Retention Period: Data is retained for several years to allow long-term performance tracking and continuity of the leaderboard.
3.4. Data Sharing and Storage: Data may be stored and processed by third-party services (such as Microsoft PlayFab).
3.5. Regulatory Compliance: The Publisher complies with applicable data protection laws, including the GDPR where relevant.

Specifically, you may also request that your username and scores no longer appear on the public leaderboard. 4.2. User Content: Scores and statistics are part of the Software’s functionality and are displayed on the public leaderboard for reference. These may be linked to your username (pseudonym) to facilitate identification and comparison.

5.1. Availability: The Publisher endeavors to keep AimX operational but does not guarantee uninterrupted availability or error-free operation.
5.2. Limitation of Liability:
* The Publisher shall not be liable for indirect damages or loss of data arising from the use or inability to use the Software.
* The Publisher is not responsible for third-party services.
5.3. Security: The Publisher implements appropriate measures to protect data. However, the User acknowledges that data transmission over the internet cannot be 100% secure.
